Your Right to a Fair Disciplinary Process in South Africa

Before an employer can discipline or dismiss you, they must follow a fair process.
Every employee has the right to be treated fairly before being disciplined or dismissed. This is called procedural fairness, and it applies no matter how serious the allegation.
What a fair procedure looks like
- Notice — you must be told, in writing, what you are alleged to have done.
- Time to prepare — you must be given reasonable time to respond and gather your side.
- A hearing — you have the right to a proper hearing, not just a decision handed to you.
- Representation — you may be assisted by a colleague or a representative.
- An impartial chairperson — the person deciding cannot be the same person who investigated.
- A reasoned outcome — you must be told the decision and the reasons for it.
Why this matters
If your employer skips these steps, a dismissal can be found procedurally unfair at the CCMA — even if the underlying reason was valid. That can lead to reinstatement or compensation.
Fair procedure is not a technicality. It is the difference between a decision done to you and one done with you.
